釣り野帳 利用規約

この利用規約（以下「本規約」といいます）は、「釣り野帳」運営者（以下「運営者」といいます）が提供する iPhone アプリ「釣り野帳」とその関連サービス（以下「本サービス」といいます）の利用条件を定めるものです。

第 1 条（適用）

  1. 本規約は、本サービスを利用するすべての方（以下「利用者」といいます）に適用されます。
  2. アプリ内の「コミュニティガイドライン」と、「プライバシーポリシー」は、本規約の一部です。
  3. App Store から入手した本アプリの使用許諾には、Apple の標準使用許諾契約（Licensed Application End User License Agreement）も適用されます。

第 2 条（アカウント）

  1. 本サービスの多くの機能は、アカウントを作成しなくても利用できます。記録のバックアップなど一部の機能は、アカウントの作成が必要です。
  2. アカウントは、メールアドレスとパスワードで作成します。登録するメールアドレスは、ご自身が使えるものにしてください。登録のときは、そのメールアドレスに確認メールを送ります。届いたメールのリンクを開くと、ログインできるようになります。
  3. パスワードはご自身で管理し、第三者に教えたり、アカウントを譲り渡したりしないでください。

第 3 条（未成年の方の利用）

未成年の方は、親権者などの法定代理人の同意を得たうえで本サービスを利用してください。

第 4 条（料金）

  1. 本サービスは、現在無料で利用できます。
  2. AI 機能と、みんなの記録への写真の公開には、1 日あたりに利用できる回数の上限があります。上限に達した場合は、翌日以降にご利用ください。

第 5 条（AI 機能）

  1. 魚種判定、見立て、ポイント診断、振り返りなどの AI 機能の結果は、天気や地形、あなたの記録から AI が推測したものです。正確であることや、釣果を保証するものではありません。
  2. AI 機能で送る内容と送り先は、プライバシーポリシーに書いています。
  3. AI 機能を、回数の上限を回避する方法や、自動化された大量の操作で利用しないでください。

第 6 条（釣り場の情報と安全）

  1. 本サービスが示す水域の情報、釣りの可否、規則、営業情報、遊漁券の情報は、表示されている確認日の時点のものです。現地の状況は変わることがあります。
  2. 釣りをする前に、現地の掲示や管理者の指示、遊漁規則、法令を必ずご自身で確認し、それに従ってください。
  3. 立入禁止の場所や私有地に入らないでください。ライフジャケットの着用など、安全には十分に注意してください。
  4. 本サービスが表示する天気や、地図上の釣り場の名前・位置などのデータの出典とライセンスは、アプリの設定の「データのライセンス」に書いています。釣り場のデータとそのライセンスは、本サイトの釣り場データのページにも書いています。

第 7 条（記録の公開、申請、意見）

  1. 本サービスでは、「みんなの記録に載せる」をオンにした記録が、みんなの記録でほかの利用者に表示されることがあります。「写真も載せる」もオンにした場合は、その記録の 1 枚目の写真も、公開前の確認（第 9 条）を経て表示されることがあります。表示される内容と条件は、プライバシーポリシーに書いています。
  2. 公開する記録と写真、釣り場の申請、見立てへの意見（以下「投稿」といいます）は、コミュニティガイドラインに従ってください。
  3. 利用者は、投稿について必要な権利（写真に写っている人の同意を含みます）を持っていること、投稿が第三者の権利を侵害しないことを保証するものとします。
  4. 運営者は、本サービスの提供、表示、集計、改善に必要な範囲で、投稿を無償で利用できるものとします（写真を公開前に確認するため、外部のサービスに送ることを含みます）。運営者が確認して、すべての利用者に表示される釣り場として本サービスに追加した釣り場の名前と位置は、本サービスの内容として公開されます。「この端末の地図にだけ表示される釣り場」として承認された釣り場は、申請した方のアプリにだけ表示され、ほかの利用者には公開されません。

第 8 条（禁止事項）

運営者は、コミュニティガイドラインに反する内容や、ほかの利用者を害する行為を容認しません。利用者は、次の行為をしてはいけません。

  1. コミュニティガイドラインに反する投稿
  2. 法令や公序良俗に反する行為
  3. 他人になりすますこと、他人のアカウントを使うこと
  4. 事実と異なる釣り場の申請や記録を、意図的に送ること
  5. 本サービスのサーバーやネットワークに過度の負担をかける行為、不正にアクセスする行為、本サービスの運営を妨げる行為
  6. 本サービスを、運営者の許可なく営利目的で利用すること
  7. その他、運営者が不適切と判断する行為

第 9 条（違反への対応）

  1. 運営者は、みんなの記録に載せる写真を、公開する前に自動でチェックします。チェックを通らなかった写真と、チェックの結果が出なかった写真は自動では公開せず、運営者が確認します。
  2. 利用者は、みんなの記録に表示された記録（写真を含みます）を、理由を選んで通報できます。
  3. 運営者は、通報を受けた記録を、通報を受けてから 24 時間以内に確認し、本規約やコミュニティガイドラインに反する記録を非表示にします。写真だけが反する場合は、写真だけを非表示にし、その記録では写真を載せられないようにすることがあります。
  4. 違反を繰り返す利用者や重大な違反をした利用者については、公開中の記録と写真をすべて非表示にし、以後の公開を止めることがあります。
  5. 法令に反する行為など重大な違反があった場合、運営者は、その利用者による本サービスの利用をお断りすることがあります。
  6. 運営者は、事前に通知することなく前各項の対応を行うことがあります。対応の理由を個別にお答えできない場合があります。

第 10 条（データのバックアップと削除）

  1. ログインしている場合、記録は運営者のサーバーにバックアップされます。ただし、通信の状況などにより、すべての記録のバックアップを保証するものではありません。大切な記録は、設定画面から書き出して保管してください。
  2. 利用者は、設定画面からいつでもデータを削除できます。ログインしている場合は、アカウントも削除できます。削除の内容は、プライバシーポリシーに書いています。

第 11 条（本サービスの変更・中断・終了）

  1. 運営者は、本サービスの内容を変更し、または提供を中断することがあります。
  2. 運営者が本サービスを終了する場合は、事前にお知らせし、データを書き出すための期間を設けます。

第 12 条（免責）

  1. 運営者は、本サービスで表示される情報（AI 機能の結果、天気、釣り場の情報、ほかの利用者の記録と写真を含みます）の正確性、完全性、有用性を保証しません。
  2. 釣行中の事故、けが、損害、第三者とのトラブルについて、運営者は、運営者の故意または重大な過失による場合を除き、責任を負いません。
  3. 運営者が責任を負う場合でも、運営者の故意または重大な過失による場合を除き、通常生ずべき直接の損害に限ります。

第 13 条（本規約の変更）

  1. 運営者は、必要に応じて本規約を変更することがあります。
  2. 変更する場合は、変更内容と効力が生じる日を、本ページとアプリの更新内容でお知らせします。利用者の権利に重要な影響がある変更は、効力が生じる日より前にお知らせします。

第 14 条（準拠法・管轄）

本規約は日本法に従って解釈されます。本サービスに関して紛争が生じた場合は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

本使用条款（以下称「本条款」）规定「釣り野帳」运营方（以下称「运营方」）提供的 iPhone 应用「野帐」及相关服务（以下称「本服务」）的使用条件。

第 1 条（适用）

  1. 本条款适用于所有使用本服务的人（以下称「用户」）。
  2. 应用内的「社区准则」与「隐私政策」是本条款的一部分。
  3. 从 App Store 获取的本应用的使用许可，同时适用 Apple 的标准最终用户许可协议（Licensed Application End User License Agreement）。

第 2 条（账号）

  1. 本服务的大多数功能不注册账号也能使用。备份记录等部分功能需要注册账号。
  2. 账号用邮箱和密码注册。请使用你本人能收信的邮箱。注册时会向该邮箱发送确认邮件，打开邮件里的链接后即可登录。
  3. 请自行保管密码，不要告诉他人，也不要转让账号。

第 3 条（未成年人的使用）

未成年人请在取得监护人等法定代理人同意后使用本服务。

第 4 条（费用）

  1. 本服务目前免费。
  2. AI 功能和向「大家的页」公开照片，每天都有可使用次数的上限。达到上限后，请在第二天以后再用。

第 5 条（AI 功能）

  1. 鱼种识别、判断（見立て）、钓点诊断、回顾等 AI 功能的结果，是 AI 根据天气、地形和你的记录推测出来的，不保证准确，也不保证钓获。
  2. AI 功能发送的内容与对象，写在隐私政策里。
  3. 请勿以规避次数上限的方法，或通过自动化的大量操作使用 AI 功能。

第 6 条（钓场信息与安全）

  1. 本服务显示的水域信息、能否垂钓、规定、营业信息、游渔证信息，是截至所显示确认日期的信息，现场情况可能已有变化。
  2. 钓鱼前，请务必亲自确认并遵守现场告示、管理方指示、游渔规定和法令。
  3. 请勿进入禁止进入的场所或私有土地。请充分注意安全，例如穿着救生衣。
  4. 本服务显示的天气、地图上水域的名称与位置等数据的来源与许可，写在应用设置的「数据许可」里。水域数据及其许可，也写在本网站的水域数据页面里。

第 7 条（记录的公开、申请与意见）

  1. 在本服务中，「放到大家的页」为开启的记录，可能会在「大家的页」上显示给其他用户。同时打开了「照片也放上去」的，该记录的第 1 张照片在经过公开前的确认（第 9 条）后，也可能会显示。显示的内容与条件写在隐私政策里。
  2. 公开的记录与照片、钓场申请、对判断的意见（以下称「投稿」）请遵守社区准则。
  3. 用户保证对投稿拥有必要的权利（包括取得照片中被拍到的人的同意），且投稿不侵害第三方的权利。
  4. 运营方可在提供、显示、汇总和改进本服务所需的范围内，无偿使用投稿（包括为在公开前确认照片而发送给外部服务）。运营方确认后作为「所有用户都能看到的钓场」加入本服务的钓场，其名称与位置会作为本服务的内容公开。被批准为「只显示在这台设备地图上的钓场」的，只出现在申请人自己的应用里，不向其他用户公开。

第 8 条（禁止事项）

运营方不容忍违反社区准则的内容和伤害其他用户的行为。用户不得有以下行为：

  1. 违反社区准则的投稿
  2. 违反法令或公序良俗的行为
  3. 冒充他人、使用他人账号
  4. 故意提交与事实不符的钓场申请或记录
  5. 给本服务的服务器或网络造成过度负担、非法访问、妨碍本服务运营的行为
  6. 未经运营方许可将本服务用于营利目的
  7. 其他运营方认为不适当的行为

第 9 条（违规处理）

  1. 运营方会在公开前对要放到「大家的页」的照片进行自动检查。没通过检查的照片、以及检查没有给出结果的照片不会自动公开，由运营方确认。
  2. 用户可以为「大家的页」上的记录（含照片）选择理由进行举报。
  3. 运营方会在收到举报后 24 小时内确认被举报的记录，并隐藏违反本条款或社区准则的记录。只有照片违规时，可能只隐藏照片，并让该记录不能再放照片。
  4. 对反复违规或严重违规的用户，运营方可能隐藏其全部公开记录与照片，并停止其之后的公开。
  5. 如有违反法令等严重违规，运营方可能拒绝该用户继续使用本服务。
  6. 运营方可能不经事先通知采取上述处理，也可能无法逐一说明处理理由。

第 10 条（数据的备份与删除）

  1. 登录后，记录会备份到运营方的服务器。但受网络状况等影响，不保证所有记录都能备份。重要的记录，请从设置页导出保存。
  2. 用户可随时在设置页删除数据；登录时也可以删除账号。删除的内容写在隐私政策里。

第 11 条（本服务的变更・中断・终止）

  1. 运营方可能变更本服务的内容，或中断提供。
  2. 运营方终止本服务时，会事先通知，并留出导出数据的期间。

第 12 条（免责）

  1. 运营方不保证本服务所显示信息（包括 AI 功能的结果、天气、钓场信息、其他用户的记录与照片）的准确性、完整性和有用性。
  2. 对钓鱼途中发生的事故、受伤、损害以及与第三方的纠纷，除运营方存在故意或重大过失的情形外，运营方不承担责任。
  3. 即使运营方需要承担责任，除故意或重大过失的情形外，也仅限于通常会发生的直接损害。

第 13 条（本条款的变更）

  1. 运营方可能根据需要变更本条款。
  2. 变更时，会在本页和应用的更新说明中告知变更内容与生效日期。对用户权利有重大影响的变更，会在生效日之前告知。

第 14 条（准据法・管辖）

本条款依日本法解释。与本服务有关的纠纷，以东京地方法院为第一审专属协议管辖法院。

Yacho Terms of Use

This English version is a reference translation; the Japanese version prevails.

These Terms of Use ("these Terms") set out the conditions for using the iPhone app Yacho and related services (the "Service") provided by the operator of Tsuri Yacho ("we").

Article 1 (Scope)

  1. These Terms apply to everyone who uses the Service ("users").
  2. The in-app Community guidelines and the Privacy Policy form part of these Terms.
  3. Your licence to use the app obtained from the App Store is also governed by Apple's standard Licensed Application End User License Agreement.

Article 2 (Accounts)

  1. Most of the Service can be used without an account. Some features, such as backing up your records, require one.
  2. Accounts are created with an email address and a password. Please use an address you can receive mail at. When you register, we send a confirmation email to that address; once you open the link in it, you can sign in.
  3. Keep your password to yourself. Do not share it or transfer your account to anyone else.

Article 3 (Minors)

If you are a minor, please use the Service with the consent of your parent or other legal guardian.

Article 4 (Fees)

  1. The Service is currently free to use.
  2. The AI features and publishing photos to Everyone's pages each have a daily limit. Once you reach it, please use them again from the next day.

Article 5 (AI features)

  1. The results of the AI features—species identification, readings, spot diagnosis and catch reviews—are estimates made by AI from the weather, the terrain and your records. They are not guaranteed to be accurate, and they do not guarantee a catch.
  2. What the AI features send, and to whom, is set out in the Privacy Policy.
  3. Do not use the AI features in ways that get around the usage limit, or through automated mass operation.

Article 6 (Fishing-spot information and safety)

  1. Information shown in the Service about waters, whether fishing is allowed, rules, opening hours and fishing permits is correct as of the check date shown. Conditions on site may have changed.
  2. Before you fish, always check and follow the signs on site, the instructions of the managers, the fishing rules and the law yourself.
  3. Do not enter restricted areas or private land. Take care of your safety, including wearing a life jacket.
  4. The sources and licences of the data the Service shows, such as the weather and the names and locations of waters on the map, are set out under "Data licenses" in the app's Settings. The water data and its licence are also set out on this site's water data page.

Article 7 (Public records, requests and feedback)

  1. Records with "Show on Everyone's pages" turned on may be shown to other users on Everyone's pages. If "Include the photo" is also on, the record's first photo may be shown too, after the pre-publication check (Article 9). What is shown, and when, is set out in the Privacy Policy.
  2. Public records and photos, fishing-spot requests and feedback on readings ("posts") must follow the Community guidelines.
  3. You confirm that you hold the rights needed for your posts (including the consent of anyone shown in your photos) and that they do not infringe anyone else's rights.
  4. We may use posts free of charge to the extent needed to provide, display, summarise and improve the Service (including sending photos to an outside service to check them before they are published). The name and location of a fishing spot that we review and add to the Service as a spot shown to all users are published as part of the Service's content. A spot approved as "shown only on this device's map" appears only in the requester's own app and is not published to other users.

Article 8 (Prohibited conduct)

We do not tolerate content that breaks the Community guidelines or conduct that harms other users. You must not:

  1. post anything that breaks the Community guidelines;
  2. break the law or public order and morals;
  3. impersonate others or use someone else's account;
  4. knowingly send false fishing-spot requests or records;
  5. place excessive load on the Service's servers or network, access them without authorisation, or interfere with running the Service;
  6. use the Service for commercial purposes without our permission;
  7. do anything else we consider inappropriate.

Article 9 (How we handle violations)

  1. We automatically check photos for Everyone's pages before they are published. Photos that do not pass, and photos for which the check gives no result, are not published automatically; we review them.
  2. You can report a record on Everyone's pages, including its photo, choosing a reason.
  3. We will review a reported record within 24 hours of receiving the report and hide records that break these Terms or the Community guidelines. If only the photo breaks them, we may hide just the photo and stop that record from showing a photo.
  4. For users who break them repeatedly or seriously, we may hide all of their public records and photos and stop them publishing further records.
  5. In serious cases, such as illegal conduct, we may refuse that user further use of the Service.
  6. We may take these steps without notice, and we may be unable to explain the reasons in individual cases.

Article 10 (Backup and deletion of data)

  1. When you are signed in, your records are backed up to our server. We cannot guarantee that every record will be backed up, for example because of network conditions. Please export important records from Settings and keep a copy.
  2. You can delete your data from Settings at any time, and, while signed in, your account as well. What is deleted is set out in the Privacy Policy.

Article 11 (Changes, suspension and termination of the Service)

  1. We may change the Service or suspend it.
  2. If we end the Service, we will tell you beforehand and give you time to export your data.

Article 12 (Disclaimer)

  1. We do not guarantee that information shown in the Service—including AI results, weather, fishing-spot information and other users' records and photos—is accurate, complete or useful.
  2. Except where caused by our intent or gross negligence, we are not liable for accidents, injuries, losses or disputes with third parties that occur while you are fishing.
  3. Where we are liable, except in cases of intent or gross negligence, our liability is limited to direct damage that would ordinarily arise.

Article 13 (Changes to these Terms)

  1. We may change these Terms when necessary.
  2. When we do, we will post the changes and the date they take effect on this page and in the app's update notes. Changes that significantly affect your rights will be announced before they take effect.

Article 14 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
